Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by calls.guru ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

calls.guru provides HIPAA-compliant call recording, transcription, and compliance scoring services for Medicare Advantage Organizations, ACA agencies, and other healthcare-related entities. Our Service includes:

  • Call recording and storage
  • Transcription of recorded calls
  • Compliance scoring and analysis
  • Long-term archiving of recordings and transcripts
  • Secure access to recordings and transcripts

3. Account Registration

To use our Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

4. Subscription and Billing

Our Service is offered on a subscription basis. You agree to pay all fees associated with your subscription plan. Fees are non-refundable except as required by law or as explicitly stated in these Terms.

Subscription plans are billed in advance on a monthly or annual basis. You may cancel your subscription at any time, but no refunds will be provided for any unused portion of your subscription period.

Credits included in your subscription plan expire as specified in your plan (30, 60, or 90 days). Additional credits may be purchased at the rates specified in your plan.

5. HIPAA Compliance and Business Associate Agreement

If you are a covered entity or business associate under HIPAA and will be transmitting Protected Health Information (PHI) through our Service, you must enter into a Business Associate Agreement (BAA) with us. The BAA establishes our respective obligations to protect PHI in accordance with HIPAA requirements.

You are responsible for ensuring that your use of our Service complies with HIPAA and other applicable laws and regulations.

6. CMS Compliance

Our Service is designed to help Medicare Advantage Organizations and ACA agencies comply with CMS requirements for call recording, monitoring, and retention. However, you are responsible for ensuring that your use of our Service meets all applicable CMS requirements.

7. Data Retention

We retain call recordings and transcripts for a period of 10 years to help you comply with CMS and other regulatory requirements. You may request deletion of your data at any time, but such deletion may affect your ability to comply with applicable regulations.

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Record calls without proper consent as required by applicable laws
  • Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service

9. Intellectual Property

The Service and its original content, features, and functionality are owned by calls.guru and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

10. Limitation of Liability

To the maximum extent permitted by law, calls.guru shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service

11. Indemnification

You agree to defend, indemnify, and hold harmless calls.guru and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
